This Rental Agreement is made on _______________ by and between _______________ (together, where applicable, the “Renter”), _______________ (the “Owner”) and David's Vacation Club Rentals Inc. (the Intermediary).
1. Terms: All Sales under this agreement are non-refundable. Price increases are not permitted.
2. Renter has been advised by Intermediary to consider the purchase of supplementary trip cancellation insurance in the event that they are required to cancel within 14-days and no longer qualify for the Deferred Dreams Cancellation Policy. If Renter has indicated that he/she is not a U.S. Resident, Intermediary also recommends that Renter consider purchasing travel health insurance.
3. Intermediary is not liable for any operations or amenities changes (collectively, “Changes”) by the Disney Vacation Club with respect to the property where Renter books his/her travel. This includes but is not limited to operations of resort restaurants, pools, play grounds and other amenities controlled by the resort. The Walt Disney Company and the Disney Vacation Club are constantly improving their resorts and properties for the current and future enjoyment of all guests. Renter’s trip or resort amenities may or may not be impacted by construction at Disney resorts and properties. While Disney might offer Renter access to alternate amenities, Intermediary and Owner assume no responsibility for Changes or situations that are not under their control.
4. Neither Intermediary nor Owner will assume any responsibility for specific room requests not honored or accepted by Disney at the time of Renter’s arrival.
5. Note: All Disney Vacation Club homes, including the balconies, are NON SMOKING. Renter will be assessed a cleaning fee by Disney Vacation Club if any NON SMOKING area is smoked in. Renter will be required to acknowledge this on check-in.
6. The Intermediary has received from Renter a NON REFUNDABLE payment of _______________ US Dollars in return for a confirmed reservation, using Owner's Disney Vacation Club points, at Disney’s _______________ in a _______________ unit to arrive on _______________ and depart on _______________ with a confirmation number of _______________.

Renter has paid to Intermediary the NON REFUNDABLE balance owing of _______________ US Dollars in full and acknowledges the ability to confirm the reservation by creating a My Disney Experience Profile, as well as pre-registering up to 60 days in advance of the scheduled arrival date. All updates to the reservation such as adding an additional guest, correcting the spelling of a guest name, room requests, additions of dining plans and ticket plans require at least 30 days advance notice to Intermediary prior to Renter’s arrival in order to allow for processing.
9. This reservation is eligible for the David's Vacation Club Rentals Deferred Dreams Cancellation Policy. The Cancellation Schedule is based on your date of check-in.
10. Renter agrees to abide by all Disney Vacation Club terms, policies and rules applicable to Disney Vacation Club owners and Disney Vacation Club membership. Renter agrees to be responsible for any unpaid charges or damages to the unit rented, (including its contents and improvements), Disney Vacation Club property and Disney property during Renter’s stay that are assessed against or charged to the Owner or Owner’s membership. Any such unpaid charges or damages so assessed or charged shall be reimbursed by Renter to the Owner or the Intermediary or their assigned agents within 60 days of notice given to Renter. Sending a fax or e-mail copy of a Disney Vacation Club or other Walt Disney Company communication assessing or describing such charges or damages shall constitute sufficient notice to Renter of such charges or damages. Renter also agrees to pay any and all fees and expenses related to the collection of any such unpaid charges or damages, including all legal fees, costs and expenses, to the Owner or the Intermediary or their assigned agents.
11. Renter also agrees to indemnify Owner and Intermediary in respect of all claims, costs, charges, and damages incurred by them, including all legal fees, costs and expenses incurred by either of them, which are caused by any wrongful, improper or negligent act or omission of Renter or any other persons permitted by Renter to occupy or access the accommodations.
12. This agreement shall be governed in all respects by the laws of the Province of Ontario and the laws of Canada applicable therein. All parties hereto agree to submit to the non-exclusive jurisdiction of the courts of Ontario with respect to any disputes relating to, or legal actions brought in respect of, any matters under this agreement.
13. In the event of a Force Majeure (as defined in this paragraph), each party shall be excused from any future performance of obligations under this agreement; provided, however that if Intermediary has collected 100% of the funds for the reservation from Renter, Intermediary will provide to Renter a Credit which is limited in value to the amount paid for the reservation which is _______________ US Dollars on such terms and conditions as determined by Intermediary in its sole discretion, as soon as is reasonably possible after the condition(s) constituting the Force Majeure event is/are notified by Intermediary to Renter and Owner. A Force Majeure is an event beyond the Intermediary’s reasonable control which renders performance of a rental reservation with respect to Owner’s rented points impossible or substantially impaired, including without limitation, acts of God, acts of government, embargoes, war, riot, epidemic, pandemic, natural disaster, governmental order restrictions and Disney Vacation Club closures or cancellation of reservations.
14. This is an agreement to rent points that represent accommodations only. There are no ticket plans, transportation, meals, transfers, insurance, or other items included. Any such optional add-on items purchased in conjunction with this reservation (e.g. dining plans and park tickets) are subject to the terms and conditions of the Disney Vacation Club, must be paid for separately by Renter and are not covered by this Rental agreement.
15. Renter understands there are no daily housekeeping services at Disney Vacation Club resorts, but rather Trash and Towel service. If Renter's stay is for less than eight nights, Renter will receive Trash & Towel service on day four. If Renter's stay is for eight nights or longer, The Renter will receive full cleaning service on day four, and Trash & Towel service on day eight. After that, the cycle begins again on day twelve. Day one is check-in day.
16. Should accommodations not be available on date of arrival due to an action or omission by the Owner, including but not limited to negligence on the part of the Owner and, after communication with the Intermediary, suitable comparable accommodations, as determined by Intermediary in Intermediary’s sole discretion, for the same dates cannot be secured by the Owner, the parties agree that Renter will be due a refund limited to the amount paid which is _______________ US Dollars which refund shall be the responsibility of Owner. In the event that the suitable comparable accommodations, as determined by Intermediary in Intermediary’s sole discretion, are available for a sum greater than the original amount paid by the Renter, the difference in value shall be the responsibility of the Owner.
17. Pets are not permitted to stay at Disney Vacation Club Resorts, except for service animals as defined by the Americans with Disabilities Act. The only exception being the Cabins at Fort Wilderness, however, Renters must follow Disney's guidelines and Pet Policy (i.e. advanced notice of dog's attendance, payment of additional fee etc.).
18. Documentation Requirements: If Renter is not an American Citizen residing in the United States of America, Renter will be required to present a valid passport in order to enter and exit the United States of America. Citizens outside of the United States of America without a valid passport will be refused entry into the United States of America. Entry into the United States of America may be refused even if the required information and travel documents are complete.
19. Living standards and practices at the destination and standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Renter’s resident country.
